  1. Novell Settles Trademark Infringement Action

  3. Assures Students Get Authorized Education Classes

  5. PROVO, Utah -- March 23, 1992 -- Novell today announced it settled a
  6. trademark infringement action against Network Systems and Services, Inc., a
  7. New York-based computer training company, to assure computer network users
  8. and resellers get legitimate, quality education classes offered under
  9. Novell trademarks.

  11. After receiving numerous complaints from students, Novell filed a lawsuit
  12. against NSSI in October 1991 in Federal District Court in New York City. 
  13. NSSI had been fraudulently representing itself as a Novell Authorized
  14. Education Center.  In the lawsuit, it was alleged that NSSI improperly
  15. assured students that its classes were sanctioned by Novell, allowed
  16. untrained and uncertified instructors to teach classes about Novell
  17. software, used inadequate computer equipment and utilized counterfeit
  18. Novell course materials.

  20. "Our customers and resellers look to Novell Authorized Education Centers
  21. for training because they recognize that only those companies meeting
  22. certain standards and conditions are awarded this prestigious designation,"
  23. said David Bradford, Novell senior vice president and general counsel.  "It
  24. is essential that we protect the investment they make in education by
  25. ensuring that the courses taken under the Novell trademark are legitimate
  26. and of the quality associated with Novell training."

  28. As part of the settlement against NSSI, the training company agreed to make
  29. an undisclosed payment to students and consented to a final judgment and
  30. permanent injunction, barring them from using Novell's registered
  31. trademarks and trade name without permission.  NSSI has also terminated the
  32. employment of an instructor who was making counterfeit copies of Novell
  33. course materials. In the future, NSSI will specifically advise all students
  34. prior to registration that NSSI is not a Novell Authorized Education
  35. Center.

  37. "20,000 end users and resellers per month take classes in network computing
  38. from more than 600 Novell Authorized Education Centers worldwide," said
  39. Carolyn Rose, director of education at Novell.  "These students rely on
  40. NAEC courses to gain understanding of the complexities of networking. 
  41. Because the subject is sophisticated, we take great care to ensure that the
  42. classes are taught by certified instructors in well-equipped facilities
  43. using Novell-developed materials."
